Terms of Use

1. Acceptance of terms

These Terms of Use ("Terms") govern your access to and use of the KidCloset mobile application ("the App"), provided by Smart Fox ApS ("we", "us", "our"), based in Copenhagen, Denmark. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Description of the App

KidCloset helps parents organize children's clothing by size, season, category, and other attributes. Without an account, data is stored locally on your device. With an optional account, you can back up that data and access it across your devices.

3. Eligibility

The App is intended for use by parents and guardians on behalf of their children. You must be at least 16 years old, or the minimum age of digital consent in your country, to create an account. If you are using the App on behalf of a child, you are responsible for any information entered about that child.

4. Accounts

Creating an account is optional and is done using Google Sign-In or Sign in with Apple. If you create an account, you are responsible for all activity that occurs under it. We do not use the email address provided by these sign-in methods for marketing purposes.

You may request deletion of your account and associated data at any time by emailing smartfox@smartfoxapps.net.

5. Subscriptions and purchases

Certain features of the App, such as cloud storage, may require an auto-renewable subscription or one-time purchase. Pricing and billing terms are presented at the point of purchase and are processed through the App Store or Google Play. Subscriptions automatically renew for the same duration unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings.

The App also offers optional one-time donations to support the developer. These are non-refundable except as required by applicable law or App Store / Google Play policy.

6. Acceptable use

You agree to use the App only for lawful purposes. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the App's systems or other users' data
• Upload content that is unlawful, harmful, or infringes on the rights of others
• Reverse engineer, decompile, or attempt to extract the source code of the App

7. Your content

You retain ownership of the content you add to the App, such as photos and item details. By using cloud storage, you grant us a limited license to store and transmit that content solely for the purpose of providing the App's services to you. We do not use your content for any other purpose, including advertising.

8. Intellectual property

The App, including its design, features, and branding, is owned by Smart Fox ApS and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

9. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that any data will be preserved without loss, although we take reasonable measures to protect your data.

10. Limitation of liability

To the maximum extent permitted by law, Smart Fox ApS shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to loss of data.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you within the App or through other reasonable means. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of Denmark, without regard to conflict of law principles.
